Terms and Conditions for Legend Infusion Personalized Wellness Mapping Service

Effective Date: July 8, 2025

By completing the wellness questionnaire form, making payment, and using the Legend Infusion Personalized Wellness Mapping Service (“Service”), you (“Client”) agree to be bound by the following Terms and Conditions (“Terms”). Please read these Terms carefully before proceeding.

  • Service Description
    1. The Service includes:
      1. Delivery of a wellness profiler device (“QiProfiler”) and a phone in a protective case to the Client, with shipping costs (to and from the Client) included.
      2. Video instructions for conducting a wellness mapping.
      3. Submission of the mapping report to Legend Infusion for analysis.
    2. A one-time Zoom consultation to discuss the scan results. 
    3. The standard fee for the Qi Profiler is $320, which includes the rental for the components listed in Section 1.1. -1.3. Legend Infusion may offer discounts during limited promotional periods, such as holidays (e.g., the 4th of July) or special occasions, using specific coupon codes. Discounts are applied at Legend Infusion’s discretion.
  • Payment and No-Refund Policy
    1. Payment is due in full upon submission of the application and wellness questionnaire forms. 
    2. Due to the nature of the Service, all sales are final, and no refunds will be issued under any circumstances.
  • Equipment Use and Return
    1. The Client agrees to use the QiProfiler and phone solely for conducting the wellness scan as instructed. 
    2. The Client must complete the scan and return the QiProfiler and phone to Legend Infusion within 48 hours of receipt, using the provided return shipping label.
    3. Failure to return the QiProfiler and phone within 48 hours will result in an automatic charge of $10 per day, billed daily, until the equipment is returned in its original condition or the total fees reach $1,545 (the combined replacement cost of the QiProfiler and phone), after which no further charges will apply. 
    4. The Client is liable for any damage to or loss of the QiProfiler or phone. Replacement costs are $1,495 for the QiProfiler and $50 for the phone.
  • Scan Access
    1. Upon initial payment for the Starter Package, the Client is entitled to use of the equipment, one wellness scan, and a strategy consultation. 
    2.  If the Client retains the QiProfiler and phone beyond 48 hours and incurs the $10 daily fee, they are entitled to one scan per month while the daily fee is active. No additional Zoom consultations are provided under the Starter Package.
  • Upgrade Options
    1. The Client may choose to upgrade to a QiProfiler purchase or a monthly rental package by notifying Legend Infusion and completing the required application form. Neither the purchase nor the monthly rental package includes consultations, which are available for an additional fee.
  • Cancellation of Daily Fee
    1. The Client may cancel the $10 daily fee for non-returned equipment by returning the QiProfiler and phone to Legend Infusion in its original condition using the provided return shipping label. No further charges will apply once the total fees reach $1,545 or the equipment is returned. 
    2. Cancellation requests must be submitted in writing to hello@reply.legendinfusion.com, and the cancellation form must be submitted.
  • Data and Privacy
    1. The Client acknowledges that scan data submitted to Legend Infusion will be used for analysis and discussed during the Zoom consultation. 
    2. Legend Infusion stores all Client data safely and securely, with access restricted to select authorized staff. Data is handled in compliance with applicable privacy laws.
  • Client Responsibilities
    1. The Client agrees to follow the provided video instructions accurately to ensure valid scan results. 
    2. Legend Infusion is not liable for inaccurate results due to improper use of the QiProfiler or failure to follow instructions.
  •  Zoom Consultation
    1. The Service includes one Zoom consultation to discuss the initial Personalized Wellness Mapping results, scheduled at a mutually agreed-upon time. No additional consultations are included.
  • 10. Limitation of Liability
    1. Legend Infusion makes no warranties regarding the accuracy or effectiveness of the wellness scan or its results. 
    2. The Client assumes all risks associated with the use of the Service and equipment.
  • Governing Law
    1. These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms shall be resolved in the courts of Texas.
  • Amendments
    1. Legend Infusion reserves the right to modify these Terms at any time. Updated Terms will be provided on the wellness questionnaire form and will be effective upon Client agreement.

Legend Infusion Wellness Scan Service (“Legend Infusion,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your data when you use our Wellness Scan Service (“Service”). By using the Service, you (“Client” or “you”) consent to the practices described in this Privacy Policy. Please read it carefully.

  • Information We Collect
    1. Personal Information: We collect information you provide when completing the wellness questionnaire form, making payment, or communicating with us, including:
      1. Name, contact details (e.g., email, phone number, address).
      2. Payment information (processed securely via our payment provider). 
    2. Health Information: We collect data from your wellness scan, including scan results and related health information submitted to us for analysis. 
    3. Usage Information: We may collect information about your interaction with the Service, such as device usage logs or consultation scheduling details.
  • How We Use Your Information
    1. We use your information to:
      1. Provide the Service, including delivering the QiProfiler and phone, analyzing scan results, and conducting the Zoom consultation.
      2. Process payments and communicate with you about the Service.
      3. Ensure the security and functionality of the Service.
      4. Comply with legal obligations or respond to legal requests. 
    2. Health information is used solely for analyzing your wellness scan and discussing results during the Zoom consultation.
  • Data Storage and Security
    1. We store your personal and health information securely using industry-standard physical, technical, and administrative safeguards to protect against unauthorized access, use, or disclosure. 
    2. Access to your data is restricted to select authorized Legend Infusion staff who need it to perform their duties related to the Service. 
    3. While we strive to protect your data, no system is completely secure. You acknowledge the inherent risks of providing information online.
  • Data Sharing and Disclosure
    1. We do not sell, rent, or share your personal or health information with third parties, except:
      1. With service providers (e.g., payment processors, shipping providers) who assist in delivering the Service and are bound by confidentiality obligations.
      2. As required by law, such as to comply with a subpoena, court order, or other legal process.
      3. To protect the safety, rights, or property of Legend Infusion or others. 
    2. Health information is only shared with authorized staff for scan analysis and consultation purposes.
  • 5. Data Retention
    1. We retain your personal and health information only as long as necessary to provide the Service, fulfill legal obligations, or resolve disputes. 
    2. After the retention period, we securely delete or anonymize your data in accordance with applicable laws.
  • Your Rights
    1. Depending on applicable law, you may have rights to:
      1. Access, correct, or request deletion of your personal information.
      2. Restrict or object to certain uses of your data.
      3. Request a copy of your data in a portable format.

    1. The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from minors. If we learn we have collected such data, we will promptly delete it.
  • Changes to This Privacy Policy
    1. We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. Updated versions will be provided via the wellness questionnaire form or emailed to Clients, effective upon distribution.
  • Governing Law
    1. This Privacy Policy is governed by the laws of the State of Texas. Any disputes arising from this policy shall be resolved in the courts of Texas.
